Welcome to Finswitch (“App”, “Platform”), owned and operated by Elitinity Space Private Limited (“Company”, “we”, “our”, “us”). By accessing or using Finswitch (including our website https://finswitch.in), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not use our services.

1. Eligibility

  • You must be at least 18 years old and legally capable of entering into contracts under the laws of India.
  • You agree to provide accurate, complete, and updated information during registration and KYC verification.

2. Services Offered

  • Finswitch enables users to invest in real estate assets through tokenized investment models.
  • We also provide information on property yields, appreciation, and related financial details.
  • Payments are processed securely via third-party providers like Razorpay.

3. User Responsibilities

By using our Platform, you agree to:

  • Provide accurate KYC and financial details.
  • Use the Platform only for lawful investment activities.
  • Not misuse the Platform for fraudulent or illegal transactions.
  • Maintain confidentiality of your login credentials.

4. Payments and Transactions

  • All payments are processed via Razorpay and other secure gateways.
  • Once an investment is made, it is subject to the terms of the specific property/project.
  • The Company is not liable for any payment failures caused by third-party payment providers.

5. Refunds & Cancellations

  • Investments once confirmed cannot be cancelled or refunded, except as required under law or project-specific terms.
  • Any refunds, if applicable, will be initiated to the original source of payment within 7–10 working days.

6. Risk Disclaimer

  • Investments in real estate carry market and regulatory risks.
  • Returns are not guaranteed and may vary depending on property performance.
  • By investing, you acknowledge and accept these risks.

7. Intellectual Property

  • All content on the Platform (logos, graphics, UI, text, etc.) is owned by Elitinity Space Private Limited.
  • You are not allowed to copy, modify, or distribute any part of the Platform without prior written consent.

8. Limitation of Liability

  • We are not responsible for losses arising from market fluctuations, third-party failures, or unauthorized access to your account.
  • Our liability, if any, shall not exceed the fees paid by you for the specific service.

9. Termination

  • We may suspend or terminate your account if you violate these Terms or applicable laws.
  • You may stop using the Platform at any time by deleting your account (subject to settlement of dues).

10. Governing Law & Jurisdiction

  • These Terms are governed by the laws of India.
  • Any disputes shall be subject to the exclusive jurisdiction of courts in Thane, Maharashtra.
